Please read these conditions carefully
1. THE CONTRACT
The Great Escape Holiday Company (GEHC) acts as Booking Agent on behalf of the property owners. The Contract entered into is between the owner of the holiday accommodation and the holiday maker (“the hirer”). The contract is only effective once the completed booking form and required payment have been received and written confirmation has been sent to the hirer. The booking is made with the Owner through us and is made in England. The Contract is subject to English Law.
2. PAYMENT
For reservations made more than eight weeks before the holiday start date, a deposit of one third of the rental cost is payable. For bookings made less than eight weeks before arrival, full payment is required on booking. Booking by credit card attracts an extra charge of 3%. This will be added to the cost of your holiday. Please send us a cheque if you do not want to incur this additional cost.
3. BALANCE OUTSTANDING
The deposit is non-refundable. The total holiday cost is payable to GEHC not later than eight weeks before the holiday start date. Failure to make full payment at the appropriate time may result in the cancellation of the booking and the forfeiture of the deposit.
4. CANCELLATION
The Hirer is strongly advised to arrange holiday cancellation insurance to give protection in the event that the hirer is unable, for any reason, to take up the holiday accommodation at the agreed time. The Hirer should notify GEHC of any cancellation immediately in writing. For any cancellation before the arrival date or on arrival, not only will any deposit be forfeited but also the balance of the total holiday will also be payable by the Hirer. If the property can be re-let then an appropriate refund will be made.
5. BOOKING ALTERATION
Rarely, for reasons beyond the control of GEHC, we have to cancel or alter arrangements made for the Hirer. In this event we will make every effort to offer the Hirer suitable, alternative accommodation. If the Hirer does not wish to accept the alternative property offered, GEHC guarantees to return to the Hirer any payment made.
6. DESCRIPTIONS
GEHC carefully inspects all properties and makes every effort to describe them fairly. However, we cannot be responsible for changes beyond our control, which have not been notified to us.
7. OCCUPANCY
Occupancy shall be from 4pm on the day of arrival to 10am on the day departure unless otherwise agreed by GEHC.
8. CARE OF THE PROPERTY
The Hirer is responsible for leaving the accommodation in good order and in clean condition. The Hirer is responsible for ensuring that he and all members of his party behave in a responsible manner both in relation to the property and the general neighbourhood during the holiday period.
A refundable damage payment of 10% of the total holiday cost or £100 whichever is the greater, (excluding any payment of
3% for use of the credit card facility) is paid to GEHC on booking your holiday accommodation. The damage payment will be returned to you after the holiday after deducting the cost of any damage to, or breakages in the property, loss or damage to linen supplied or the provision of any extra services required to return the property to its original condition. Please allow up to 28 days for return of the payment. Any residue will be returned to the Hirer who should report any breakages/damages to GEHC on arrival.
In the event that there is any damage to, or breakage in the property, which is considered serious by GEHC or the Owner, the right to repossess the property during the holiday period is reserved.
9. NUMBERS OF PEOPLE USING THE HOLIDAY ACCOMMODATION
Under no circumstances may more than the maximum number of persons as stated in the brochure occupy a property. Admittance may be refused if this condition is not observed. GEHC reserves the right to refuse or revoke bookings from parties which may in its opinion be unsuitable for the property concerned. In such cases, all hire charges will be refundable in full and the contract will be discharged. Names and addresses of all people staying at the holiday property will be required to be given to GEHC at the time of booking.
10. LIABILITIES
Neither GEHC as Agent nor the Owner of your holiday accommodation can accept liability nor loss of any nature whatsoever suffered by any person from any cause whatsoever arising in connection with that person’s occupation or attendance at the holiday accommodation.
11. COMPLAINTS PROCEDURE
The hirer must notify GEHC immediately if a problem arises and we will do our best to rectify it as soon as possible so that we can ensure that you enjoy the rest of your holiday with the minimum of inconvenience.
Our telephone number for any problems is 08456 340 511 and our office is open 08:30 to 17:30 Monday to Friday. We cannot recompense you if we are not made aware of any problem at the time and you must write to us confirming the complaint within seven days of the end of your holiday.
12. PETS
In some properties in our brochure well-behaved dogs will be accepted by prior arrangement. In this case, your dog must not be allowed to lie on bedding or upholstery, must not be left unattended at the property and all fouling must be cleaned up by the hirer. A charge of £15 (UK Pounds) per week is levied. In view of past experiences, should visitors bring dogs to properties that are advertised as No Dog properties, visitors will NOT be allowed to stay at that property and the company will not refund the holiday cost.
13. V.A.T
Prices quoted include VAT at 17.5% and GEHC reserves the right to charge the hirer any increase which may take place.
14. FORCE MAJEURE
Neither the property owner nor GEHC shall be in breach of this contract if there is any total or partial failure of its performance of any of its obligations under this contract which results from causes not under its reasonable control including, but not limited to fires, strikes, lockouts or other industrial action, inability to obtain supplies or services, or regulations of any civil or military authority.
